Fed: High court dismisses Catholic application in IVF case

The High Court has dismissed an application by the Catholic Church to prevent a singlewoman from gaining access to IVF in Victoria.

The High Court unanimously dismissed the challenge by the Catholic Church and the federalgovernment to prevent LEESA MELDRUM from having IVF treatment in Victoria.

In 2000, the federal court ruled she was entitled to IVF treatment in Victoria.

The Australian Catholic Bishops' Conference challenged the Federal Court's decision.

But as the conference had no standing in its own right, Attorney-General DARYL WILLIAMSgranted the bishops a rarely-used fiat authority reserved for those who can't otherwiseseek court orders.

Justices MARY GAUDRON and WILLIAM GUMMOW said the attorney-general can't have a rovingcommission to begin litigation and disrupt already-settled cases.

In his judgment, Chief Justice MURRAY GLEESON said the court had been asked by peoplewho weren't parties to the Federal Court action to quash its decision on the grounds itwas wrong.
