RED: Shell acquiring Woodside contrary to national interest = 4

Mr Costello said it was in the national interest for sales from the NWS project to
be promoted above sales from competing projects elsewhere in the world.

He said he had decided not to allow the takeover with conditions.

"Whilst there have been positive decisions with Shell on steps to secure the independence
of the operator and marketing functions I have not been able to see that enduring conditions
which are fully enforceable could be put in place in advance, as such conditions would
require action after the approval and require the consent of joint parties which cannot
be guaranteed," he said.
